Nebraska Pipeline Law Struck Down

Posted: Updated:

OMAHA (KPTM)- The Keystone Pipeline just hit a huge wall in Nebraska.

Lancaster County District Court Judge Stephanie Stacy struck down a Nebraska law Wednesday that would have given TransCanada permission to run a crude oil pipeline through the state.

This is good news for the three Nebraska landowners who challenged the law.

The ruling prevents Governor Dave Heineman, and the Nebraska Department of Environmental Quality from taking any further action to authorize or advance the pipeline under the unconstitutional law.

Siding with three landowner plaintiffs, the District Court concluded that under Nebraska's State Constitution, exclusive control over pipeline must be done by the Nebraska Public Service Commission, and cannot be given to the Governor.
