HOUSTON, May 5, 2014 /PRNewswire/ -- In an opinion published May 1, the Federal Circuit reversed a grant of summary judgment of no infringement by the District Court for the Northern District of Ohio. Sutton McAughan Deaver PLLC attorneys Bob McAughan and Jeff Andrews represented plaintiff GE Lighting Solutions, LLC with Richard Rainey, GE Executive Counsel for IP Litigation.
At issue in the appeal were three of the district court's claim constructions affecting four of GE Lighting Solutions' asserted patents. Based on these claim constructions, the district court had granted summary judgment of no infringement on the four GE patents, in favor of the defendant. On review, the Federal Circuit rejected the district court's construction of one term, adopted GE's construction, and reversed the grant of summary judgment on two of the four asserted patents. On a second claim term, the Federal Circuit rejected the district court's application of a claim construction agreed by the parties and remanded the case for further proceedings on the genuine issue of fact that was created with regard to the third patent. The Federal Circuit affirmed the third claim construction, which only affected the fourth asserted patent.
The case on appeal is GE Lighting Solutions, LLC v. Agilight, Inc., Case No. 2013-1267.
According to Bob McAughan, "This appeal is a great example of the way Sutton McAughan Deaver partners with its clients to provide the best possible solutions within the changing landscape of legal representation." In this case, Sutton McAughan Deaver teamed with the in-house GE team throughout the appeal. Mr. Rainey, a seasoned patent litigator, argued the case at the Federal Circuit.
"We are very proud of our continued success on behalf of our clients in the full range of patent dispute venues," said managing partner Al Deaver. "Our experience in court trials, appeals to the Federal Circuit, proceedings before the Patent and Trademark Office, and alternative dispute resolution means that our client receive outstanding representation to protect their intellectual property and business interests no matter where and how a dispute may arise."
